TERMS, CONDITIONS AND LIABILITY DISCLAIMER
1. Nature of the Company's Services
The Company acts solely as an organiser, coordinator and intermediary for the purpose of arranging and facilitating tours, excursions, accommodation, vehicle rentals, transportation services, road trips and other travel-related experiences.
All such services are provided by independent third-party service providers acting in their own name and under their own responsibility.
2. Reservations and Availability
All bookings, reservations and arrangements made by the Company are subject to availability and confirmation by the relevant service provider.
3. Force Majeure and Legitimate Cause
The Company shall not be held liable for any cancellation, postponement, interruption, modification, reduction, delay or non-performance of any reservation, tour, excursion, activity, accommodation, transportation service or other arrangement resulting from force majeure or any legitimate cause.
For the purposes of this clause, "force majeure" and "legitimate cause" shall include, without limitation:
Cyclones, storms, floods, rough sea conditions (mer houleuse), adverse weather conditions or natural disasters;
Safety concerns affecting clients, staff or service providers;
Technical failures, mechanical breakdowns or operational difficulties affecting the performance of a service;
Port, airport or road closures;
Government directives, restrictions, regulations or administrative decisions;
Public health emergencies, epidemics or pandemics;
Industrial action, strikes, labour disputes or civil disturbances;
Acts of terrorism, war, threats to public security or any event beyond the reasonable control of the Company or the service provider;
Any circumstance which, in the reasonable opinion of the Company, renders the performance of the service impossible, impracticable, unsafe or commercially unreasonable.
In such circumstances, the Company may, at its sole discretion:
(a) reschedule the affected reservation, tour, excursion, activity or service; or
(b) reimburse the Client for the cancelled service, subject to any non-refundable charges, fees or deductions imposed by the relevant service provider.
The choice between rescheduling and reimbursement shall rest exclusively with the Company.
4. Independent Service Providers
The Client acknowledges and agrees that all accommodation providers, vehicle rental companies, transport operators, boat operators, excursion providers, guides and other suppliers engaged in connection with any booking are independent contractors.
No service provider shall be deemed to be an employee, partner, or agent of the Company.
The Company acts solely as an intermediary and booking facilitator. Any contract relating to accommodation, transportation, excursions, activities or other services shall be deemed to be entered into directly between the Client and the relevant service provider.
5. Limitation of Liability
The Company’s liability is strictly limited to the organisation, coordination and facilitation of tours, itineraries and bookings expressly confirmed by the Company.
To the fullest extent permitted by law, the Company shall not be liable for any loss, damage, injury, illness, accident, delay, inconvenience, cancellation, theft, death or any other claim arising directly or indirectly from:
the acts, omissions, negligence or default of any service provider;
the performance, non-performance or improper performance of services by any service provider;
the cancellation, interruption, postponement or modification of any service, tour or booking;
weather conditions, sea conditions or other natural events;
force majeure or any legitimate cause beyond the reasonable control of the Company or the relevant service provider;
any act or omission of the Client or any third party.
Where any liability of the Company is established notwithstanding the foregoing, such liability shall be strictly limited to the fees actually received by the Company in respect of the specific booking or itinerary giving rise to the claim.
6. Accidents, Injuries and Incidents
Any accident, injury, illness, death, loss, damage or incident occurring during the provision of accommodation, transportation, vehicle rental, excursions, boat trips, leisure activities or any other service shall be the sole responsibility of the relevant service provider.
The Client agrees that any claim arising from such event shall be directed exclusively against the responsible service provider.
7. Scope of Responsibility
The Company's responsibility is strictly limited to:
Organising and coordinating reservations;
Planning itineraries and outings;
Arranging accommodation bookings;
Arranging vehicle rental and delivery services;
Coordinating inland excursions and activities;
Coordinating boat excursions and marine activities through authorised operators;
Facilitating road trips and island discovery experiences.
The Company shall not be responsible for any facilities, services, amenities, benefits, representations or undertakings offered directly by any service provider beyond those expressly communicated by the Company.
8. Food and Beverages
Unless expressly stated otherwise in writing, all meals, beverages, refreshments and personal expenses shall be borne solely by the Client.
9. Client Responsibility
The Client shall ensure that he or she is medically fit and capable of participating in the booked activities.
The Client shall comply with all safety instructions, regulations and directions issued by the Company and/or any service provider.
The Company reserves the right to refuse or terminate participation in any activity where the conduct of the Client may endanger persons, property or the proper execution of the activity.
10. Governing Law and Jurisdiction
These Terms and Disclaimer shall be governed by and construed in accordance with the laws of the Republic of Mauritius.
Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent Courts of Mauritius.
11. Acceptance
By requesting a booking, making a reservation, effecting payment or participating in any tour, excursion, activity or service organised by the Company, the Client acknowledges having read, understood and accepted these Terms and Conditions and agrees to be bound by them.
